STEARNS —
Two McCreary County couples are among a total of 14 indicted Thursday by a federal grand jury on Social Security and health care fraud.
Both cases involve the federal Supplemental Security Income (SSI) program and Medicaid, for which SSI recipients automatically qualify in Kentucky. The defendants are accused of lying about living separately from their spouses in order to qualify for more disability benefits. The charges include Social Security Fraud, Theft of Government Property, Health Care Fraud and Making False Statements.
Henrietta Winchester, 65, and her husband Denver Winchester, 70, have been jointly named in an indictment which states that, between September 1989 and July 2012, Mrs. Winchester received an overpayment of benefits amounting to $87,492.49 from SSI and $35,847 from Medicaid. On October 18, 2010, the Winchesters told a Social Security Administration representative that they had been living apart since 1991.
Similarly, Francis Terry, 65, and her husband Albert Terry, 70, were indicted because Mrs. Terry received overpayments of $82,159 in SSI and $120,792 in Medicaid between September 1997 and April 2012. The Terrys told an SSA representative in April 2012 that they had been living separately for some 20 years.
The London grand jury returned nine other indictments last week for defendants living in Whitley, Leslie, Pike, Bell, Perry and Laurel counties. The government alleges that it has been defrauded out of more than a million dollars in these cases.
The health care fraud and theft of government property charges carry a maximum penalty of 10 years in prison. The charges of social security fraud and making false statements carry a maximum of 5 years in prison.
