LOUISVILLE—Just two weeks after his medical license was suspended by the Tennessee Board of Medical Examiners for alleged sexual misconduct, Larry E. Perry, MD, was placed under similar sanctions from the Kentucky Board of Medical Licensure (KBML).
Last week KBML publicly released an Emergency Order of Suspension issued for Dr. Perry on November 19 and effective upon his receipt of the document the following day. The board’s decision was based not on allegations involving Dr. Perry’s Kentucky practice but rather the Tennessee Department of Health’s 28-page report regarding his Oneida practice, which closed earlier this year.
The report, dated September 4, details the investigation as conducted by Tennesee Bureau of Investigation Special Agent Margaret Chuinard beginning on July 8, 2008.
The report alleges that “Dr. Larry Perry overprescribes controlled substances, especially Xanax. He is requesting sexual favors in exchange for the medications.”
Agent Chuinard concluded a four-month undercover operation in January 2009 which includes audio tapes.
“On her first visit [the undercover agent] asked for Hydrocodone…,” the report reads. “Dr. Perry did not prescribe Hydrocodone on the first visit. He later prescribed an increasing quantity on the last three visits. The investigation was terminated because Dr. Perry became overly cautious. Special Agent Chuinard reported he might have known he was being investigated.”
TBI used pharmacy data from the first six months of 2008 and interviews of patients in the Oneida and Huntsville areas which were collected July 21-23, 2009.
Based on the pharmacy data, Special Agent Chuinard selected five or six dozen patients to interview. A total of 21 victims, who have not been identified due to the continuing investigation, were included in the report.
The initial two victims reported their stories at the Oneida Police Department on July 10, 2008. Victim #1 reported seeing Dr. Perry only once because he rubbed his genitals against her leg. Victim #2 was allegedly kissed and forced to place her hand on his erect penis.
Others who were interviewed reported unnecessary Pap tests and inappropriate comments. More than one reported that Dr. Perry would sometimes lock the door before beginning an exam.
Victim #21 recounted performing oral sex on Dr. Perry in exchange for him increasing her Xanax dosage.
In addition to Agent Chuinard’s complaint, seven other witnesses were included in the report. Some were former employees of Dr. Perry.
Upon closing his Oneida office, the general practitioner joined the Whitley City office his father, Dr. Hoover Perry, operates with Dr. Nancy West. KBML is investigating Larry Perry’s Kentucky practice.
“This Board has initiated an investigation into the licensee’s actions in the Commonwealth of Kentucky and that investigation is pending,” the order reads. “Inquiry Panel A has authorized amendment of the Complaint and of this Emergency Order of Suspension to include allegations of any violations within the Commonwealth.”
Dr. Perry has 30 days from the time he was suspended to respond. Failure to do so “may be taken as an admission of guilt.” A formal hearing has been scheduled for March 9-11 before the Kentucky board in Louisville.
