With last Tuesday’s alcohol referendum fresh on everyone’s mind, the man who spearheaded the effort to get the issue on the ballot is considering his next move.
Losing the legalization of countywide alcohol sales by just 47 votes, it comes as no surprise that Scottie Morrow would ask for a recanvass to confirm the results. What may surprise many, however, is that Morrow does not have standing to do so.
After consulting state election officials as well as County Attorney Michele Wilson Jones, McCreary County Clerk Eric Haynes advised Morrow that only a candidate can request a recanvass. As this election had no candidates, a recanvass cannot be conducted.
In order to challenge the results, Morrow (or any citizen) could seek a recount but that takes legal action.
Morrow appears to be leaning in that direction. According to Haynes, Morrow submitted an open records request seeking a list of voters turned away from the polls. When Morrow revealed that he has consulted an attorney, Haynes advised him that he could no longer discuss the issue with him.
“I’ve left it in our county attorney’s hands,” Haynes said. “We’ll just have to wait and see if he files.”
Haynes did speak to the Record about reports that some people couldn’t vote but said that in those few instances, the voter was either not registered at all or registered in another county.
“It is so important for citizens to check their registration before an election,” Haynes said.
The clerk also addressed an hour-long power outage at Wiborg, Cumberland Falls and Eagle. Haynes said voting continued as normal, with the ballots secured in a separate slot in the machine. Once power had been restored, election officials scanned the ballots through the machine. The incident, he added, was reported to all proper authorities.
“I have an excellent staff and well-trained poll workers,” Haynes said. “I’m confident in the process and that this result would stand.”
Morrow told the Record that he had 10 days from the election to challenge the result.
“I’m interested in anyone who was not allowed to vote for any reason or who has knowledge of irregularities,” Morrow said, adding that his number is 606-310-4202.
Supporters will have to wait three years before seeking another countywide referendum. However the issue could be taken up again in individual precincts. Half of the county’s 18 precincts voted yes to alcohol sales in last Tuesday’s election.
